- In submitting an entry to the Singapore in “Tag Along & Win” Contest (the "Contest"), organised by the Singapore Tourism Board ("STB"), you are deemed to accept these terms and conditions (this "Agreement").
- The Contest is open to all individuals, regardless of age, nationality and country of residence. However, employees of the STB, STB's representative offices, authorised agencies, contractors and principal sponsors associated with this Contest, and immediate family members of all such employees are not eligible to enter the Contest. Corporate or other entities are also not eligible to participate in this Contest.
- No person under twenty-one (21) years of age shall be eligible to win a prize under this lucky draw unless his/her parents or legal guardians have jointly and severally consented and agreed, in such form and upon such terms as prescribed by STB, to the minor’s participation in the lucky draw. Failure to sign and return such documents within the time specified by STB or comply with any term or condition therein shall result in disqualification or ineligibility for prizes.
- All details and particulars submitted must be true, accurate, complete and up to date. Entries that do not meet this requirement will be disqualified. Participants shall provide STB with such proof of identity, residence and/or citizenship as STB may require from time to time.
- All entries must be emailed to I_am_Not_On_Sale@live.com and comply with the specifications for submissions stipulated or otherwise approved by STB. All photographs must be in digital form, in JPEG (.jpg) format only and must not be of more than 1 megabyte (MB) in size. STB reserves the right to disqualify entries that do not comply with these specifications.
- The Contest commences on Saturday 20 June 2009 and closes on Sunday 26 July 2009. All entries must be received no later than 2359hours on 26 July 2009 (Singapore time).
- STB accepts no responsibility for late, lost, garbled or misdirected entries.
- Each entry shall contain only one photograph. Multiple entries per participant are permitted.
- All details and particulars submitted must be true, accurate and complete. Any incorrect or incomplete information submitted will result in the disqualification of the entry. By submitting your details and particulars, you consent to STB and its sponsors using such information, including the public disclosure of the same, and contacting you for the marketing efforts of STB and/or its sponsors. You agree to participate in, at your own expense, prize presentation ceremonies and all other publicity events in Singapore in relation to the Contest, without payment or compensation. You further consent to the public disclosure of any statement, comment or quotation that you may give, and the reproduction, adaptation and translation into any language and publication of the same by STB.
- Ten winners will be selected. All winners will be notified by 2 August 2009 by email or post in accordance with the email/ postal addresses provided with their entries. All winners shall acknowledge receipt of such notice in the manner and within the time limit prescribed by STB, failing which STB shall be entitled to treat the prize as forfeited and to select another winner.
- The winners of the Contest will be selected by a panel of judges appointed by STB. The decision of the judges appointed by STB shall be final and no correspondence with participants will be entertained.
- The decisions of STB on all matters relating to the Contest, including but not limited to the eligibility of participants, conduct of the Contest, shortlisting of the photographs, the winners of the Contest, and the determination or replacement or substitution of any winners or prizes, shall be final and no correspondence with participants will be entertained.
- Each winner will be notified by email or phone in accordance with the contact details provided with their entries. If a winner does not acknowledge receipt of such notice or collect the prize within the time limit prescribed by STB, STB shall be entitled to treat the prize as forfeited and to select another winner. Winners will be notified of the prize collection details and shall collect and utilize the prizes in the manner instructed at their own cost and expense. The winners' names will also be published on the Website. Non-Singaporean winners will receive their prizes, subject to the eligibility criterias in this Agreement, via courier to the addresses submitted with their entries, and are required to acknowledge receipt of their prizes via email to STB.
- Prizes to be given are:
1ST PRIZE (Three winners) Apple iPod Touch (32GB)
2ND PRIZE (Three winners) Sony PSP
MERIT PRIZE (Four winners) Apple iPod Shuffle (1GB)
- Prizes are not transferable, exchangeable or redeemable for cash, credit or other benefit in-kind. Prizes are also subject to the validity periods and any other terms and conditions as may be imposed by the prize sponsors. All prizes are not inclusive of any taxes and other expenses / costs, all of which are the sole responsibility of the winners.
- If you have won a prize, STB will contact you by telephone or email. You will also receive a notice by ordinary mail. Results of the Contest will also be posted on the Visit Singapore website. However, you will not be eligible for prizes if STB does not receive your reply to its email, confirming receipt.
- A prize that is unclaimed after 2 months from the date the winner is informed of his/her win will be forfeited. STB reserves the right to draw reserve winners and award prizes to them in the event of the disqualification of an earlier winner or failure of an earlier winner to claim the prize.
- It is a condition of award of any prize that the prize winner must consent, without compensation, to disclosure by STB of his/her name, identification/passport number and photograph for publicity purposes and to otherwise participate in STB’s publicity activities relating to the Contest.
- The prize winner shall, if required by STB, execute an affidavit of eligibility, a release of liability and a publicity release giving STB permission to use his/her name, picture, image and voice for publicity purposes without compensation. Failure to provide such documentation or to comply with any terms and conditions therein shall result in disqualification or ineligibility for prizes.
- Notwithstanding anything in this Agreement, STB reserves the right at any time in its absolute discretion to:
- cancel or modify the Contest;
- determine and/or amend, by addition to, deletion from or variation of, these terms and conditions without prior notification, including but not limited to, the eligibility terms and criteria, the selection of winners, and the timing and venue of any act to be done, and all participants and winners shall be bound by such determination and/or amendments; and/or
- substitute, withdraw or cancel any prize without prior notice and without having to disclose any reason therefore and without any payment or compensation whatsoever.
- All entries submitted for the Contest, including all photographs and images submitted, will be the sole property of STB, and will not be returned.
- The entire right, title and interest (including intellectual property rights) in and to the winning entries (whether or not prize winning) and all materials submitted with your entry, and in and to all works based upon, derived from, or incorporating your entry or any part thereof shall vest exclusively in STB, its successors and assigns. You shall do all things and sign and execute all documents as STB may reasonably require to perfect, protect or enforce any intellectual property rights assigned to STB under this Agreement. STB shall be entitled, without further reference to you, to exercise all intellectual property rights in your entry, including the use, adaptation, modification, reproduction, translation, exhibition, publication, display and archival of your entry or any part thereof in any context and with or without other material, in any medium now known or hereafter devised, whether or not for profit, for the full period of protection arising pursuant to the laws in force in any part of the world including all renewals reversions and extensions and to authorise others to do the same. In no event shall STB be required to use any entry, whether in whole or in part. For non-winning entries, you retain all rights to your work. By submitting your work here, you grant STB the rights to do the following: put it on the web, on print, and use it in our promotions. Credits will be given to the participant if STB chooses to use your photographs for any of the stated purpose.
- You warrant to STB that (a) your entry is an original work and you have the necessary right, power and authority to assign to STB all rights, title and interest in and to the entry as required in this Agreement; (b) STB’s or its sponsors’ use of the entry in accordance with this Agreement will not infringe or violate any intellectual property rights or other rights of a third party; (c) you waive and have obtained waivers from any contributors to your entry of all moral rights or rights to be named as author(s) in relation to the entry or any part thereof; and (d) nothing in the entry is libellous, slanderous, defamatory, scandalous, threatening, obscene, pornographic, offensive, lewd, improper or of such a nature which contravenes any laws, or may subject STB or its sponsors to any action, proceedings or demands from any persons, and is not likely to damage or bring into disrepute the name or reputation of STB or its sponsors.
- If required by STB, you shall at no expense to STB provide a high quality copy of the photograph submitted with your entry or render such reasonable assistance as STB may require to use or implement your entry for the purposes contemplated in this Agreement.
- STB, STB’s representative offices, authorized agencies, contractors and sponsors, and the directors, officers, employees and assignees thereof shall not be liable for (a) any claim, damage, loss, injury or inconvenience arising out or in connection with the Contest or any prize, including the award thereof to or use thereof by any person; (b) any event of force majeure, including without limitation any calamity or conditions, acts of God, war or warlike hostilities, civil commotion, riots, blockades, embargoes, sabotages, strikes, fires, lockouts, shortages of material or labour, terrorist activity, epidemic, quarantine restrictions, health risk or any other occurrence beyond the reasonable control of STB nor any of STB’s representative offices, authorized agencies, contractors and sponsors; (c) any entries or other communications that have been lost, late, illegible, incomplete, tampered with, corrupted, mutilated, misdirected or undelivered for any reason; or (d) any defect, failure, interruption, breakdown, malfunction, delay or unavailability of any postal services, machine, computer system, hardware, software, data processing system, email account, communications network or transmission link or other cause that in any way prevents or limits any person’s ability to submit a valid entry to the Contest or receive communications or that causes any damage to any person’s computer systems.
- You hereby release STB, STB’s representative offices, authorized agencies, contractors and sponsors, and the directors, officers, employees and assignees thereof, completely from any and all claims, demands, causes of action, expenses, damages, attorneys’ fees, obligations and suits, of any kind, in law, equity or otherwise, whether known or unknown, disclosed and undisclosed, now or hereafter arising out of or in connection with the Contest, any prizes, your breach of any term or warranty of this Agreement and/or your acts or omissions in relation thereto. You further agree to indemnify and hold harmless STB, STB’s representative offices, authorized agencies, contractors and sponsors, and the directors, officers, employees and assignees thereof, from and against any and all such claims, demands, causes of action, expenses, damages, attorneys’ fees, obligations and suits.
- This Agreement is governed by and construed in accordance with the laws of the Republic of Singapore, and you submit to the non-exclusive jurisdiction of the courts of Singapore in the determination of any matter or dispute arising in connection therewith.
- This Agreement is not intended to confer rights on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act (Cap 53B) or otherwise, and no third party shall have any right to enforce any provision of this Agreement.
